ADJA Public Directory Terms of Use

These Public Directory Terms of Use (“Terms”) govern access to and use of the American Disc Jockey Association (“ADJA”) public directory, including any online listings, profiles, search tools, and related services provided through ADJA websites, including but not limited to www.adja.org and www.adja-dj.org (collectively, the “Directory”).

By accessing, viewing, searching, using, or otherwise interacting with the Directory, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Directory.

1. PURPOSE OF THE DIRECTORY

The ADJA Public Directory is provided for the purpose of allowing consumers, businesses, event professionals, and other interested parties to locate and contact professional DJs and related entertainment providers who have chosen to participate in the directory.

The Directory is intended solely as a resource to connect users with listed Members.

2. NO GUARANTEE OR ENDORSEMENT

Inclusion within the ADJA Public Directory does not constitute an endorsement, certification, guarantee, warranty, or representation by ADJA regarding any listed Member, including but not limited to:

  • Quality of services;
  • Experience;
  • Professional ability;
  • Pricing;
  • Availability;
  • Business practices;
  • Reliability;
  • Performance; or
  • Results.

ADJA is not a party to any agreement, contract, transaction, or relationship between a Directory user and any listed Member.

Users are solely responsible for researching, selecting, and engaging any DJ or service provider.

3. DIRECTORY INFORMATION

Directory information is submitted by ADJA Members.

ADJA makes reasonable efforts to provide accurate information but does not guarantee that all information contained within the Directory is complete, accurate, current, or error-free.

ADJA is not responsible for:

  • Incorrect information submitted by Members;
  • Outdated information;
  • Missing information;
  • Typographical errors;
  • Changes in Member status;
  • Member business practices; or
  • Any consequences resulting from reliance upon Directory information.

4. MEMBER LISTINGS AND REMOVAL

ADJA reserves the right to add, modify, suspend, remove, or discontinue any Directory listing at any time.

Listings may be removed, hidden, or disabled for reasons including but not limited to:

  • Membership expiration;
  • Membership cancellation;
  • Suspension or termination of membership;
  • Violation of ADJA policies;
  • Technical issues;
  • Administrative decisions; or
  • Any other reason deemed appropriate by ADJA.

ADJA has no obligation to maintain, restore, or republish any listing.

5. ACCEPTABLE USE

Users may use the Directory only for legitimate purposes, including locating and contacting individual DJs or entertainment providers.

Users agree not to misuse the Directory or any information contained within it.

6. PROHIBITED USE OF DIRECTORY INFORMATION

Without the prior written permission of ADJA, users may not:

  • Copy, reproduce, or distribute Directory information;
  • Download or store Directory data in bulk;
  • Scrape, crawl, harvest, or collect Directory information;
  • Use automated tools, bots, spiders, scripts, artificial intelligence systems, or other technology to extract information;
  • Create competing databases, directories, or lists;
  • Sell, rent, transfer, or provide Directory information to third parties;
  • Use Directory information for unsolicited marketing or advertising;
  • Create mailing lists, email lists, telephone lists, or solicitation databases;
  • Use Directory information for spam, telemarketing, or sales campaigns;
  • Misrepresent an affiliation with ADJA; or
  • Use Directory information for any purpose that could harm ADJA or its Members.

7. MONITORING AND ENFORCEMENT

ADJA reserves the right to monitor use of the Directory and employ reasonable technical, investigative, and verification methods to identify unauthorized access, copying, harvesting, or misuse of Directory information.

ADJA may use monitoring methods, including test records, verification profiles, or other detection methods, to determine whether Directory information has been improperly obtained or used.

Users acknowledge and agree that evidence obtained through such methods may be used in legal proceedings.

8. UNAUTHORIZED COPYING AND DAMAGES

Unauthorized copying, harvesting, distribution, or commercial use of Directory information causes harm to ADJA and its Members.

ADJA reserves the right to pursue all available legal remedies against any individual or entity that violates these Terms, including but not limited to:

  • Injunctive relief;
  • Recovery of damages;
  • Recovery of profits obtained through unauthorized use;
  • Recovery of attorneys’ fees and legal costs where permitted by law; and
  • Any other remedies available under applicable law.

9. PRIVACY

Use of the Directory is also subject to ADJA’s Privacy Policy.

Users acknowledge that information displayed within the Directory has been voluntarily provided by participating Members for public display.

10. THIRD-PARTY CONTACT

Directory users understand that contacting a listed Member creates a direct relationship between the user and that Member.

ADJA is not responsible for communications, agreements, disputes, transactions, services, payments, cancellations, damages, or claims arising between users and Members.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ADJA shall not be liable for any damages arising from or related to:

  • Use of the Directory;
  • Reliance on Directory information;
  • Contact with listed Members;
  • Member services or business practices;
  • Errors or omissions in listings;
  • Website availability;
  • Unauthorized access or misuse of information by third parties; or
  • Any transaction or relationship between users and Members.

12. CHANGES TO THESE TERMS

ADJA reserves the right to update, modify, or revise these Terms at any time.

Continued use of the Directory following any changes constitutes acceptance of the updated Terms.

13. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any legal action arising from or relating to these Terms shall be brought in the appropriate state or federal courts located in Florida, and users consent to the jurisdiction of such courts.

14. ELECTRONIC ACCEPTANCE

By accessing or using the ADJA Public Directory, users acknowledge that they have read, understood, and agree to these Terms.

Electronic acceptance, electronic records, and electronic acknowledgment shall constitute a valid and binding agreement.
